Acceptance of Terms

Welcome to Told Ya! These Terms of Service ("Terms") are a legal agreement between you and Timeside, LLC ("we," "us," "our") governing your use of the Told Ya mobile application (the "Service").

By using Told Ya, you agree to these Terms. If you don't agree, don't use the Service.

We may update these Terms with 30 days' notice via email or in-app notification. Continued use means you accept the changes.

1. Eligibility

Age: You must be 13+ to use Told Ya
Account: Required via Google OAuth authentication
Responsibility: You're responsible for account security
One Account: No sharing accounts or creating multiple accounts

2. What Told Ya Is

                        Entertainment Only: Told Ya is a social challenge and prediction platform for fun among friends. It is NOT:
                        A gambling platform
A legally binding contract service
A financial services provider
Real money betting

                    

We facilitate: Social challenges, friendly predictions, and group competitions. That's it.

3. Challenges

How They Work:

Types: Binary (yes/no), numeric guesses, multiple choice, date predictions, photo challenges, dares
Privacy: Semi-private (visible only to invited participants, NOT publicly searchable)
Verification: Creator-determined, group vote, photo proof, or preset answer
Results: Posted by creator or determined automatically

As Creator, You:

Set challenge question, type, closing time
Choose verification method
Invite participants via join codes
Post results in a timely manner (when applicable)

As Participant, You:

Submit responses before closing time
Agree to the verification method chosen
Accept that your response may be visible to other participants (based on visibility settings)
Can leave challenges before they close

4. Stakes & Wagers

IMPORTANT: Stakes are NOT enforced by Told Ya.

Stakes are social/entertainment only (e.g., "loser buys coffee")
Honor system between participants
We don't facilitate payments or transactions
You're solely responsible for honoring stakes you agree to

Prohibited Stakes:

Real money gambling
Illegal activities
Physical harm or danger
Harassment or bullying
Anything involving minors inappropriately

5. Acceptable Use

You May NOT:

Post offensive, abusive, hateful, or discriminatory content
Harass, bully, or threaten others
Create challenges involving illegal activities
Use the Service for real money gambling
Share sexually explicit content
Impersonate others
Use bots or automated tools
Manipulate challenges or results through fraud
Create multiple accounts after suspension

Violations Result In:

Content removal
Account warnings
Temporary suspension
Permanent termination

Reporting: Use the in-app report button to flag inappropriate content. We review reports and take appropriate action.

6. PRO Subscription

Plans:

Monthly: $4.99/month (7-day free trial)
Annual: $29.99/year (14-day free trial)

PRO Features:

Unlimited challenge creation (free tier is limited)
Premium challenge templates
Advanced analytics
Ad-free experience
Priority support

Payment & Billing:

Processed via RevenueCat through Apple App Store or Google Play Store
Auto-renews unless cancelled 24+ hours before period ends
Manage/cancel via device subscription settings (not in-app)
Free trial converts to paid subscription unless cancelled

Refunds:

Handled by Apple/Google per their policies
Contact Apple Support or Google Play Support
No refunds for Terms violations

7. Account Deletion

You can delete your account anytime: Settings > Account > Delete Account

What Happens (Immediately):

Account permanently deactivated (no reactivation)
Email/OAuth credentials disconnected
Profile inaccessible
Personal identifiers removed

Anonymization (Immediate):

Your identity is removed
Display name → "Deleted User"
Avatar → Generic placeholder
Challenges you created remain active (anonymized)
Your responses preserved (anonymized) for challenge integrity

Why anonymization? Other participants rely on challenge data. We remove your identity immediately but keep anonymized records so their challenges aren't disrupted.

This is permanent and cannot be undone.

8. Content & Intellectual Property

Your Content:

You own content you create (challenges, responses, photos)
You grant us a license to display your content to challenge participants and operate the Service
You're responsible for obtaining consent from people in photos/videos

Our Content:

Told Ya's design, features, and code are owned by Timeside, LLC
Protected by copyright and trademark laws
You may not copy, modify, or create derivative works

9. Disclaimers

"AS IS" SERVICE: Told Ya is provided "as is" without warranties of any kind.

WE DO NOT GUARANTEE:

Accuracy of challenge results
That participants will honor stakes
That challenges will be resolved fairly
Uninterrupted or error-free service
That defects will be corrected

YOU ACKNOWLEDGE:

Participation is at your own risk
You're responsible for interactions with other users
Result verification is community-based (no guarantee of accuracy)
Disputes are between participants, not us

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

We are NOT liable for:

Indirect, incidental, or consequential damages
Loss of profits, data, or goodwill
Damages from unauthorized account access
Damages from user conduct or content
Damages from third-party services

MAXIMUM LIABILITY: The greater of (a) amounts you paid us in the past 12 months, or (b) $100 USD.

11. Dispute Resolution

Governing Law:

California law governs these Terms (without conflict of law principles).

Informal Resolution:

Contact contact@friendwagers.com and attempt to resolve disputes informally for 30 days before taking legal action.

Binding Arbitration:

Disputes resolved by binding arbitration through the American Arbitration Association (AAA) in Sacramento, California.

Individual basis only (no class arbitrations)
Arbitrator's decision is final and binding
Each party bears their own costs unless arbitrator decides otherwise

Exceptions:

Small claims court (for disputes within jurisdiction)
Injunctive relief for intellectual property infringement

Class Action Waiver:

You waive any right to participate in a class action lawsuit or class-wide arbitration.

12. Termination

You Can:

Terminate anytime by deleting your account (see Section 7)

We Can:

Suspend/terminate your account immediately for:

Terms violations
Fraudulent or illegal activity
Harassment or harm to others
Creating multiple accounts after suspension
Legal requirements

Effect: Your access ceases, subscription cancelled (no refund for violations), content anonymized per Section 7.

13. General

Entire Agreement: These Terms + Privacy Policy constitute the complete agreement
Severability: If any provision is invalid, the rest remains in effect
No Waiver: Our failure to enforce doesn't waive our rights
Assignment: You can't transfer these Terms; we can assign to affiliates/successors
California Residents: Contact the CA Dept of Consumer Affairs (800-952-5210) with complaints
Apple/Google Terms: If downloaded from App Store/Play Store, their terms also apply

✓ Stakes/wagers are NOT enforced by the app
✓ You agree to binding arbitration and waive class action rights
✓ Account deletion is permanent
✓ You can exercise your rights anytime
